TUTELA PENAL DE LA PROPIEDAD INTELECTUAL

Abstract

[ES] Este trabajo se centra en la protección que el legislador otorga a la Propiedad Intelectual. A través de la normativa nacional estudiaremos los derechos que la propiedad intelectual otorga a sus titulares así como su medio de protección civil, administrativo o penal, dedicando una especial atención a éste último. Para ello se analizarán los delitos regulados en los artículos 270 ( en todos sus apartados) y 271 del Código Penal, centrándose en los elementos que componen el tipo básico: sujeto, objeto material, y conducta típica , así como la determinación del bien jurídico protegido de todos ellos. Además también se estudiará la normativa europea que afecta a España en dicho tema, como Estado miembro, en dónde se destacará la nueva directiva aprobada por el Parlamento Europeo en cuanto al uso de los derechos de autor en el mundo digital.

[EN] This work focuses on the protection afforded by the legislator to Intellectual Property. Through national legislation we will study the rights that intellectual property grants to its owners as well as its means of civil, administrative or criminal protection, paying special attention to the latter For this purpose, the offences covered by Articles 270 (in all paragraphs) and 271 of the Penal Code shall be analysed, focusing on the elements that make up the basic type: subject, material object and typical behaviour, as well as the determination of the protected legal good of all of them. In addition, the European legislation affecting Spain in this area will also be considered, as a Member State where the new directive adopted by the European Parliament on the use of copyright in the digital world will be highlighted.
