La pena de muerte vista desde el Tribunal Europeo de Derechos Humanos y la Unión Europea

Abstract

[ES] La finalidad de este Trabajo Fin de Grado es realizar un estudio sobre la pena de muerte, especialmente a nivel europeo. El objetivo principal es analizar la regulación de la pena capital tanto por la Unión Europea como por el Consejo de Europa y establecer al mismo tiempo similitudes y diferencias entre ambas formas de regulación. Además, nos enfocaremos en conocer el nivel de protección del que disponen los ciudadanos europeos frente a este tipo de castigo e investigaremos el caso del único país de Europa que tiene incorporada la pena de muerte en su legislación en la actualidad. Asimismo, analizaremos como el Tribunal Europeo de Derechos Humanos aplica el Convenio Europeo de Derechos Humanos y orienta a los Estados a la creación de leyes internas.[EN] The purpose of this research project is to carry out a study of the death penalty, especially in the European countries. The main objective is to analyze capital punishment legislation by the European Union and the Council of Europe and establish similarities and differences between both forms of regulation. In addition, we will focus on seeing the level of protection available to the European citizens against this type of punishment and we will investigate the case of the only country in Europe that has incorporated the death penalty into its legislation nowadays. We will also analyze how the European Court of Human Rights applies he European Convention on Human Rights and guides States to the creation of internal laws.
