Algunas cuestiones sobre la desobediencia CNIL y la objeción de conciencia

Abstract

En este trabajo analizaremos dos institucione s jurídico -políticas que guardan relación con el cumplimiento del derecho. Son las siguientes: la desobediencia civil y la objeción de conciencia . Analizaré las similitudes y diferencias entre una y otra institución y también abordaré comparat ivamente las razones éticas y políticas que justifican la obligación de obedecer y desobedecer al derecho y su relación con la obligación política. Finalmente, me referiré a un posible derecho a la desobediencia civil y la incidencia de ésta como causa de justificación de una acción contraria al Ordenamiento jurídico.

In this work we discuss two legal-political institutions that relate to compliance with the law. These institutions are: the civil disobedience and the conscientious objection. 1 will discuss the similarities and differences between each institution and comparatively 1 will address the ethical and political reasons far the obligation to abey and disobey the law and its relationship with political obligation. Finally, 1 will refer to a possible right to civil disobedience and the incidence of civil disobedience as a justificati on of an action contrary to the legal system.
