La eutanasia desde una perspectiva constitucional: el derecho a la vida.

Abstract

Aunque la eutanasia no es un problema que haya surgido recientemente, ya que es una práctica que se lleva debatiendo durante siglos, en estos últimos años el debate se ha intensificado. La multitud de avances médicos hace que nos planteemos como la sociedad debe tratar a algunos enfermos terminales y personas que se encuentran en un estado de salud incurable e irreversible, solicitando morir para evitar el sufrimiento que su enfermedad les provoca. El artículo 15 de la Constitución Española recoge el derecho fundamental a la vida. Sin embargo, el derecho a la muerte no viene expresamente recogido en ese artículo. En este trabajo vamos a analizar si la eutanasia puede considerarse protegida por nuestra constitución, vamos a comparar nuestra legislación con la de otros países sobre este tema, y conoceremos a fondo todo lo que implica este concepto, sus diferentes clasificaciones y su historia. Although euthanasia is not a problem that has come up recently, as it is a practice that has been debated for centuries, in recent years the debate has intensified. The multitude of medical advances makes us consider how society should treat some terminally ill and people who are in an incurable and irreversible state of health, requesting to die to avoid suffering caused by their disease. Article 15 of the Spanish Constitution includes the fundamental right to life. However, the right to death is not expressly included in that article. In this work we are going to analyze if euthanasia can be considered protected by our constitution, we are going to compare our legislation with that of other countries on this subject, and we will know in depth everything that this concept implies, its different classifications and its history.
