LA RESPONSABILIDAD CIVIL POR DAÑOS DERIVADOS DE MEDICAMENTOS

Resumen
[ES] El presente proyecto de fin de grado focaliza su análisis en la responsabilidad civil originada como consecuencia de los daños producidos por medicamentos, llevando a cabo un método inductivo que pretende obtener una conclusión general a partir de dos premisas particulares: el estudio, por un lado, del paradigmático caso de la talidomida y, por otro, del menos conocido caso de la vacuna contra el virus del papiloma humano, Gardasil. Teniendo en cuenta ambos casos, se busca comparar la incidencia de uno y otro en el ámbito de la responsabilidad civil, así como sus posibles vías de reclamación indemnizatoria. De esta forma, el estudio de un suceso que causó daños masivos, en contraposición de un episodio cuya repercusión en España ha sido mínima permite observar en qué circunstancias se reparan efectivamente lesiones las cuales los sujetos afectados no están obligados a soportar.
[EN] The present final degree project focuses its analysis on the civil liability arising as a result of the damage caused by drugs, carrying out an inductive method that seeks to obtain a general conclusion from two particular premises: on the one hand, the study of the paradigmatic case of thalidomide and, on the other hand, the unknown case of HPV vaccine, Gardasil. Given both cases, it pursues to compare the incidence of both in the field of liability and the possibles ways of a compensating claim. In this way, the study of an event that caused massive damages, as a contraposition to an episode whose impact has been minimal in Spain can observe when the damages suffered by the affected persons are effectively repaired and when it doesn't happen.
