El discurso del odio: mecanismos legales de protección y regulación a nivel europeo

Abstract

[ES]El presente trabajo ofrece un estudio jurídico-penal minucioso del discurso del odio y su relación con el derecho a la libertad de expresión, desde una perspectiva tanto nacional como internacional se identifican los mecanismos legales que han sido creados para resolver estas situaciones, así como la evolución jurisprudencial y legislativa sufrida a largo de los últimos años, incluyéndose la nueva redacción dada al artículo 510 CP por la Ley Orgánica 1/2015, de 30 de Marzo.

[EN]The present work offers a thorough penal and legal study of the hate speech and its relation to the right to freedom of speech. From both international and national perspectives, it aims to identify the legal mechanisms created to solve these situations, as well as the jurisprudential and legislative evolution throughout the past years, including the new writing given to the article 510CP by the Organic Law 1/2015, May 30th.
