EL SEGURO: EL ASEGURADO EN EL SEGURO DE DAÑOS Y EL SEGURO DE VIDA”

Abstract

[ES] A través de la lectura de este trabajo vamos a tratar, comprender y analizar que es el contrato de seguros, la normativa vigente, sus elementos, y clases. Centradnos en dos de estas clases, el seguro de daños, donde analizaremos su definición y elementos, así como las distintas clases y el derecho de vida, analizándolo de la misma forma que el de daños. Centrándonos finalmente en la figura del asegurado, centrándonos en su definición y comprobando si es un elemento totalmente protegido por la Ley, esto lo podremos ver a través del estudio de las diferentes clausulas limitativas y delimitadoras existentes en el derecho mercantil que hacen que el derecho del asegurado quede expuesto, y si en los dos seguros anteriormente estudiados existen esta desprotección a través del estudio de algunas sentencias.

[EN] Through the reading of this work we will try, understand and analyze what is the insurance contract, the current regulations, its elements, and classes. Focus on two of these classes, the damage insurance, where we will analyze its definition and elements, as well as the different classes and the right to life, analyzing it in the same way as damage. Focusing finally on the figure of the insured, focusing on its definition and checking whether it is an element fully protected by the Law, we can see this through the study of the different limiting and delimiting clauses existing in commercial law that make the right of the insured is exposed, and if in the two insurances previously studied there is this deprotection through the study of some sentences.
