El Riesgo en el Contrato de Compraventa

Abstract

[ES]En este trabajo analizaré el riesgo en el contrato de compraventa. Se trata de dar a conocer este riesgo puesto que este tipo de contrato es uno de los más usuales y frecuentes utilizados por la sociedad, no sólo por personas físicas, sino también personas jurídicas. Cuando un contrato de compraventa es formalizado, surgen obligaciones para las partes implicadas, las cuales deben cumplir con lo pactado. En caso de incumplimiento hay que saber qué riesgos son soportados por el comprador y vendedor, así como las consecuencias de estos y si se puede optar por la resolución del contrato. Por tanto, hay que analizar los distintos puntos de vista sobre este tema, desde el Código Civil español (sobre todo el artículo 1452), así como los numerosos autores que han escrito sobre el tema.

[EN]In this work, I will analyse the risk in the contract of sale. It’s about making known this risk since this type of contract is one of the most usual and frequent used by society, not only by natural persons, but also by legal persons. When a contract of sale is legalized, obligations arise for the parties involved, which must comply with the agreement. In case of non-compliance we have to know what risks are borne by the buyer and seller, as well as the consequences of these and if it can to opt for the contract resolution So we have to analyse the different viewpoints about this topic, from the Spanish Civil Code (especially the article 1452), as well as the numerous authors who have written about the topic.
