Resumen
La crisis pandémica de la COVID-19 ha sido el detonante para que
en España se empiece a regular el teletrabajo. Una modalidad de
trabajo a distancia que se caracteriza por el uso intensivo de las
nuevas tecnologías. Una forma de trabajo que no es tan novedosa
para muchas personas trabajadoras españolas, que la ejercían con
anterioridad de la crisis pandémica, sin una regulación estatal
especifica.
La inteligencia artificial dirige, supervisa y controla a la persona
teletrabajadora, empleando algoritmos digitales, sin necesidad de
una personalidad humana. A su vez, el empleo de los algoritmos
digitales carece de una regulación en el ámbito laboral, que afecta
plenamente en los derechos de las personas trabajadoras, en
concreto: la conciliación familiar y personal, la intimidad y la
desconexión digital. Siendo necesaria una regulación jurídico-
laboral que proporcione una información detallada y de visibilidad
a los algoritmos, para evitar la discriminación de las personas
teletrabajadoras.
The COVID-19 pandemic crisis has been the trigger for teleworking to begun to regulated in Spain. A form of remote work that is characterized by the intensive use of new technologies. A type of work that is not so new for many Spanish workers, who worked before the pandemic crisis, without specific state regulation. The artificial intelligence directs, supervises and controls the teleworker, by using digital algorithms, without needing for a human personality. In turn, the use of digital algorithms lacks regulation in the workplace, which fully affects the rights of workers, specifically: family and personal conciliation, privacy and digital disconnection. Being necessary a legal regulation that provides information and visibility to the algorithms, to avoid discrimination against teleworkers.
