Delito de entradas y registros ilegales

Abstract

[ES]El derecho de inviolabilidad del domicilio es un derecho fundamental recogido en nuestra Constitución y tiene como finalidad la protección del ámbito de la intimidad de las personas en su vida personal y familiar, el cual permite excluir a terceros de su área de privacidad elegido voluntariamente. En tal sentido, a través del presente trabajo, se pretende abordar el procedimiento para llevar a efecto la entrada y registro en el domicilio de residentes en España, en virtud de la sistemática marcada por la LECrim como medida de investigación; de igual forma, se acomete el estudio propio de la figura penal, en cuanto a ilícito cometido por autoridad o funcionario público en extralimitación de las garantías legales y constitucionales; para ello se analiza el delito previsto en el artículo 534 de nuestro Texto punitivo, con determinación de la antijuridicidad, culpabilidad y punibilidad.

[EN]The right of inviolability of the domicile is a fundamental right recognized in our Constitution and its purpose is the protection of the privacy of persons in their personal and family life, which allows third parties to be excluded from their voluntarily chosen area of privacy. In this sense, through the present work, the intention is to approach the procedure to carry out the entry and registration in the domicile of residents in Spain, by virtue of the system marked by the LECrim as a research measure, likewise, is undertaken the proper study of the criminal figure, as regards the wrongful act committed by the authority or public official in the overstepping of legal and constitutional guarantees; for this purpose, we analyze the crime foreseen in article 534 of our punitive text, with determination of the unlawfullness, culpability and punishability.
