LIBERACIÓN Y DETENCIÓN DE BUQUES A TRAVÉS DE LA JURISPRUDENCIA DE TRIBUNAL INTERNACIONAL DEL DERECHO DEL MAR

Abstract

[ES] El trabajo lleva a cabo un análisis normativo y jurisprudencial acerca de la liberación y retención de buques en el ámbito internacional, partiendo de la condición jurídica de los mismos y de las instituciones reguladas en la Convención que van a mediar en esta disputa. Para ello, se van utilizar tres casos ya resueltos por el Tribunal Internacional del Derecho del Mar y extraer de los mismos la información necesaria que nos ayude comprender de una manera mejor la liberación y retención de buques desde la perspectiva de la Convención.

[EN] The essay carries out a normative and jurisprudential development about liberation and retention ships in the international arena, based on the legal status of them and the institutions regulated by the Convention that will mediate this dispute. For it, it will use three cases already settled by the International Tribunal for the Law of the Sea and extract from them the necessary information to help us understand in a better way release and detention of vessels from the perspective of the Convention.
