La incapacidad temporal

Abstract

[ES]En este TFG presentamos un estudio de la prestación por Incapacidad Temporal de la Seguridad Social. Desde su nacimiento, los requisitos indispensables para acceder y tener derecho a la misma, la función que llevan a cabo los distintos sujetos que intervienen, las reformas que han sufrido sus textos legislativos, especialmente la reciente reforma en el papel que desempeñan las Mutuas. El objetivo es analizar todo el proceso que se desarrolla desde que se produce la baja del trabajador hasta que se le da el alta, o concurren otras situaciones como puede ser pasar a una incapacidad permanente, o la muerte del trabajador,… Por último, se hace referencia a la pérdida económica que sufre nuestro sistema de Seguridad Social, como causa del absentismo y fraude que se produce por parte del trabajador en esta prestación, y de otro lado, la precaria protección que sufre a veces el trabajador a causa de las reformas legislativas que sufre la prestación por Incapacidad Temporal.

[EN]This TFG presents a study of the benefit for temporary incapacity of the Social Security. From its birth, the essential requirements to access and to have the right to it, the function carried out by the different subjects involved, the reforms that have undergone its legislative texts, specelly the recent reform inserted into the Mutuals. The aim of this TFG is to analyze the process between the drop until the discharge of the worker, or other situations such as passing to permanent incapacity, or the death of the worker,… Finally, it makes reference to economic loss suffered by our Social Security Sistem, that is, the cause of absenteeism and fraud that occurs on the part of the worker in this benefit, and on the other hand, the precarious protection sometimes suffered by the worker because of the legislative reforms that suffer the benefit for temporary incapacity.
