RESPONSABILIDAD POR OMISIÓN DE LA IGLESIA CATÓLICA EN DELITOS SEXUALES CONTRA MENORES

Abstract

La responsabilidad por omisión de la Iglesia Católica ante delitos sexuales contra menores, así como el bien jurídico desprotegido, la libertad e indemnidad sexual, es un tema que está sufriendo una gran envergadura y transcendencia en los últimos años; no sólo por el incremento de denuncias, procesos y sentencias, relativo a los mismos, sino por la gran desprotección que sufren las víctimas ante la gran omisión, tanto en el ámbito eclesiástico, como en la sociedad, en general. Pretendo, poner en relieve las diferencias entre los distintos delitos omisivos, centrándome en la posible responsabilidad en que podrían incurrir los superiores jerárquicos con su omisión, a través de la posición de garante. Así mismo, basándome en las teorías de la complicidad participativa dispuestas por autores penalistas, en los delitos de omisión, ofrezco mi postulación en la práctica jurídica, a través de casos que, aunque a priori puedan parecer similares, no lo son.

The responsibility for omission by the Catholic Church’s side towards sexual offences to children, as well as the legal interest protected, sexual integrity and freedom, have become a significant topic with a vital importance for the last years up to nowadays. Not only for the increasing number of public denounces, processes and judgements, but also for the high lack of protection wich victims suffer from, due to the omission by the Church and society in general. I will try to highlight the differences among the omissive offences, putting the focus on the presumed responsibility of the high hierarchies of the Church with their omission, thru the warrantor position. Thus, I will base my positions on the connivance theories depicted by criminal authors in omissive offences. I offer my opinion thru cases wich may seem similar to each other but actually they do not.
