LAS SECTAS EN EL MARCO JURÍDICO DE LA LIBERTAD RELIGIOSA Y LA FUNCIÓN DEL REGISTRO DE ENTIDADES RELIGIOSAS

Abstract

Este estudio se centra en la existencia de los grupos sectarios que, al amparo de la libertad religiosa, infringen la ley, planteando problemas para el ordenamiento jurídico de cualquier Estado. Asimismo, se explican los intentos realizados en nuestro país para hacerles frente. Para ello se analiza el Registro de Entidades Religiosas, figura clave en nuestro ordenamiento por la importante función que desempeña en el reconocimiento oficial de los grupos religiosos como confesiones. También se analizan algunas sentencias importantes en la materia, poniendo como ejemplo algunos grupos cuyos casos nos ayudarán a entender mejor la cuestión suscitada. Además, se compara la situación y la solución seguidas en nuestro país con las de Francia, señalando algunas de las diferencias más acusadas entre ambos Estados.

This study focuses on the existence of sectarian groups that, under the protection of religious freedom, violate the law, posing problems for the legal system of any State. Likewise, attempts made in our country to face these groups are explained. For this, the Registry of Religious Entities is analyzed, a key figure in our system due to the important role it plays in the official recognition of religious groups as confessions. Some important judgments on the matter are also analyzed, giving as example some groups whose cases will help us to better understand the question raised. In addition, the situation and the solution followed in our country are compared with those of France, pointing out some of the most pronounced differences between both States.
