Resumen
[ES]En el presente trabajo se ofrece una visión global sobre la influencia cultural en actos delictivos o delitos culturalmente motivados, aportando características definitorias y distintivas y abordándola tanto desde el ámbito legal, como doctrinal y jurisprudencial. Desde el legal, se estudia su inclusión en distintas regulaciones internacionales, incluida la española. Respecto al doctrinal, se recopilan las distintas posturas adoptadas en la evaluación de delitos culturalmente motivados así como las soluciones propuestas. En cuanto al jurisprudencial, se repasan la mayoría de las resoluciones en las que se ha valorado el bagaje cultural del individuo hasta la actualidad. Todo esto se lleva a cabo para justificar la conveniencia de la adopción en el ordenamiento de una teoría intermedia entre el universalismo y el relativismo cultural, de forma que fuera capaz de partir de una igualdad jurídica de las diferencias que contiene la diversidad cultural.
[EN]This paper seeks to offer a global view on cultural influence in criminal acts or criminally motivated crimes, providing distinctive characteristics and addressing it from the legal, doctrinal and jurisprudential. From the legal point of view, its inclusion in different international regulations, including the Spanish one, is studies. From the doctrinal point of view, the different positions adopted in the evaluation of culturally motivated crimes as well as the proposed solutions are complied. Regarding jurisprudence, most of the judgments in which the cultural background has been valued up, are reviewed. All this is done to justify the appropriateness of an intermediate theory between universalism and cultural relativism in order to be able to start from a legal equality of the differences contained in cultural diversity.
