El proceso de incapacitación

Abstract

[ES] Comenzaremos definiendo que es la incapacitación y la capacidad que tienen tanto los niños como los adolescentes. Analizaremos la capacidad de los menores emancipados y las condiciones necesarias para el ejercicio efectivo de la misma. Continuaremos con intervención del Ministerio Fiscal en el proceso de determinación de la capacidad de obrar. Además, haremos mención al internamiento urgente. Por último hablaremos de la fase probatoria.

[EN] We will being by defining what is the incapacitation and capacity that both children and adolescents have. We will analyze the capacity of emancipated minors and the necessary conditions for the effective exercise of it. We will continue with the intervention of the Public Prosecutor in the process of determining the capacity to act. In addition, we will mention the urgent internment.
