Resumen
[ES] El presente trabajo pretende abordar el tema de la expropiación forzosa. Hablaremos del objeto de la expropiación, los sujetos que intervienen, el procedimiento ordinario desde la determinación de utilidad pública o interés social siguiendo por la fijación del justiprecio.
También se estudiará el procedimiento de urgencia, analizando los beneficios y ventajas que aporta tal proceso, ya que debido a la rapidez con la que se ocupa el bien, éste será más ventajoso para el beneficiario.
Por último, se analizará de forma especial la responsabilidad por demora, debido a que en numerosas ocasiones se producen situaciones en la que transcurre un plazo excesivo desde el día siguiente en el que se haya adquirido un acuerdo de necesidad de ocupación, y el momento de la fijación del justiprecio o, que no se cumplan los plazos en los que el expropiado deba recibir el justo precio.
[EN] The present work aims to address the issue of forced expropriation. We will talk about the object of the expropriation, the subjects that intervene, the ordinary procedure from the determination of public utility or social interest following by the setting of the just price. The procedure of urgency will also be studied, analyzing the benefits and advantages that such a process brings, since due to the speed with which the good is occupied, this will be more advantageous for the beneficiary. Finally, responsibility for delay will be analyzed in a special way, because in many cases there are situations in which an excessive period elapses from the next day in which an agreement of need for occupation has been acquired, and the time of the setting of the fair price or, that the deadlines in which the expropriated party should receive the fair price are not met.
