Resumen
En la sociedad actual, uno de los principales problemas
ambientales es, sin duda, la contaminación acústica que sufren
numerosos ciudadanos, especialmente en los medios urbanos. Sus
efectos nocivos han hecho que se incrementen las vías de
protección para frenar el impacto que produce sobre la salud, así
como en la vida cotidiana.
La Constitución española reconoce el derecho a disfrutar de un
medio ambiente adecuado, e impone a los poderes públicos la
obligación de defenderlo y restaurarlo. Sin embargo, el Tribunal
Europeo de Derechos Humanos, fue más allá en la lucha contra el
ruido, considerándolo un agente contaminante susceptible de
violar el contenido protegido de los derechos fundamentales.
El objetivo por tanto de este trabajo, es examinar la Doctrina del
Tribunal Europeo de Derechos Humanos, Tribunal Constitucional
y Tribunal Supremo. Asimismo, analizar el importante papel
ejercido por la Administración Local en la regulación de las
ordenanzas municipales en este ámbito.
In today's society, one of the main environmental problems is undoubtedly the noise pollution suffered by many citizens, especially in urban areas. Its harmful effects have increased the means of protection to slow down the impact it produces on health, as well as in daily life. The Spanish Constitution recognises the right to enjoy an adequate environment, and imposes on the public powers the obligation to defend and restore it. However, the European Court of Human Rights went further in the fight against noise, considering it a pollutant capable of violating the content protected by fundamental rights. Therefore, the objective of this work is to examine the Doctrine of the European Court of Human Rights, Constitutional Court and Supreme Court. Likewise, analyse the important role played by the Local Administration in the regulation of municipal ordinances in this area.
