La protección internacional de la vida humana en el mar Mediterráneo

Abstract

En este trabajo se expone el origen de la obligación internacional de prestar auxilio a las personas que se encuentran en peligro en el mar y se analizan las diferentes normas de derecho internacional público referentes a la protección internacional de la vida humana en el mar con motivo de la situación de crisis migratoria y de refugiados que ha experimentado la ruta migratoria del Mediterráneo Central. Se ha diferenciado entre los Convenios internacionales y el sistema de protección internacional regional y se han analizado para determinar si las acusaciones realizadas por las ONG que operan en el mar Mediterráneo en relación con el incumplimiento de los derechos humanos son ciertas. A pesar de que la normativa internacional en este sentido es bastante clara, los Estados miembros de la Unión Europea aún no han conseguido establecer una política migratoria que regule sus fronteras exteriores conforme a los Convenios internacionales. In the present work we are exposed the origin of the international obligation to provide people’s assistance who are in danger at sea and we analyze the different laws of public international law about the international protection of life at sea. This has been done due to the migration and refugee crisis that has happened in the Central Mediterranean. We have differentiated between the International Conventions and the regional international protection system to determine if it is true the allegations made by NGO operating in the Mediterranean Sea about the breach of human rights. The international law is pretty clear, but the Member States of the European Union have not yet established a migration policy that regulates their external borders in accordance with International Conventions.
