El derecho penal de autor durante el franquismo: la represión de la homosexualidad

Abstract

[ES] El concepto de memoria histórica ha suscitado un gran debate en los últimos años, entre quienes son partidarios del reconocimiento a las víctimas de la Guerra Civil y el franquismo, línea bajo la que se aprueba la Ley 52/2007; y quienes prefieren cerrar este capítulo de la historia. El presente Trabajo de Fin de Grado parte de la premisa del conocimiento, y pretende mostrar una visión global de la situación enfrentada por el colectivo LGTBI durante la Dictadura franquista. El objetivo principal del proyecto es profundizar en las nociones de derecho penal de autor y peligrosidad sin delito. Tarea que se lleva a cabo mediante la confrontación de fuentes históricas, doctrinales, jurisprudenciales y el análisis de la regulación española vigente en este periodo, en especial, la conocida Ley de Vagos y Maleantes y su sucesora, la Ley de Peligrosidad y Rehabilitación Social.

[EN] The concept of historical memory has caused a great discussion in recent years, among those who are in favour of the appreciaton of the victims of the Civil War and the Franco regime, line under which the Law 52/2007 was approved; and those who prefer to close this chapter of history. The present End of Degree Project starts from the premise of knowledge, and aims to show a global view of the situation faced by the LGTBI collective during the Franco’s Dictatorship. The main objective of the work is to study in depth the notions of author’s criminal law and riskiness without crime. Task that is carried out through the comparison of historical, doctrinal and jurisprudential sources, and the analysis of the Spanish applicable regulation in this period, especially, the well-known Law of Vagues and Nasties and its successor, the Law of Riskiness and Social Rehabilitation.
