Resumen
El 24 de marzo de 2021 sucedió un hito en España: se
aprobó la Ley Orgánica 3/2021, la primera Ley Reguladora de la
Eutanasia en nuestro país. Pero no lo hizo en ausencia de
polémica: sin el consenso que debería de primar en la regulación
de derechos fundamentales, se trata de una ley que es y será muy
discutida. Así, el debate público se ha centrado en cuestiones
políticas y criminales de su regulación. Sin embargo, ¿qué sucede
con su encaje constitucional? ¿Permite la Constitución Española
de 1978, la norma suprema del ordenamiento jurídico, configurar
un nuevo derecho como es el derecho a morir?
El Estado siempre ha jugado, por su rol nacido del seno de
la Constitución, un papel vital en las garantías del derecho a la
vida de todos los españoles. Pero también en la defensa de la libre
autonomía personal, la dignidad del ser humano, la libertad de
conciencia y su libre desarrollo personal. ¿Hasta dónde llega la
libertad de decidir sobre uno mismo y sobre su propia
supervivencia?
Y el eterno debate: ¿vida o libertad?
On March 24, 2021, a milestone was reached in Spain: Organic Law 3/2021, the first Law Regulating Euthanasia in our country, was passed. But it did not do so in the absence of controversy: without consensus prevailing in the regulation of a fundamental right. Thus, public debate has focused on political and criminal issues of its regulation. But what about its constitutional fit: does the Spanish Constitution of 1978, the supreme rule of the legal system, allow for the configuration of a new right such as the right to die? The State has always played a vital role in guaranteeing the right to life of all Spanish people. But also in the defense of free personal autonomy, dignity, freedom of conscience and free personal development. How far does the freedom to decide on one's own survival go? And the eternal question: Life or freedom?
