Los delitos societarios, su funcionalidad y aplicabilidad

Abstract

[ES] El objeto de presente trabajo es analizar los artículos 291 y 293 del Código Penal, con la finalidad de determinar su funcionalidad actual. Para ello, se realizará una retrospectiva tanto social como legislativa, que podrá de manifiesto las necesidades incriminatorias antes de que estas figuras formaran parte del texto punitivo, y que se aprobó a través de la Ley Orgánica 10/1995, de 23 de noviembre, y la relación tan estrecha que guardan las conductas típicas con el ámbito mercantil.

[EN] The purpose of this paper is to analyze articles 291 and 293 of the Criminal Code, in order to determine its current functionality. To do this, I will make a retrospective both social and legislative, which may show the incriminating needs before these figures were part of the punitive text, and which was approved through Organic Law 10/1995, of November 23, and the So close relationship that the typical behaviors with the commercial sphere.
