El contrato de compraventa en el derecho romano y su evolución histórica

Abstract

[ES] El presente Trabajo está compuesto por una introducción, tres capítulos y unas conclusiones, finalizando con una bibliografía.

Primeramente, un primer epígrafe, distribuyéndose en ocho sub epígrafes. En primer lugar, el surgimiento de la compraventa procedente de las figuras arcaicas con sus características respectivas. A continuación, se desarrollan las compraventas especiales. El cuarto sub epígrafe desarrolla los elementos constitutivos de la compraventa: consentimiento, cosa y precio. Posteriormente, las obligaciones del vendedor y las del comprador. El penúltimo apartado se basa en los pactos añadidos a la compraventa y un sub apartado que trata las figuras arcaicas. Finalmente, el tercer epígrafe trata la compraventa en los períodos romanos postclásico y justinianeo.

El segundo capítulo trata la compraventa en el Derecho Civil Español en las diferentes etapas históricas hasta la actualidad con el Código Civil como norma actual.

El tercer y último capítulo esboza los proyectos de unificación en materia de contratos en la Unión Europea.

[EN] This work is composed of an introduction, three chapters and conclusions, ending with a bibliography.

First, a first heading, distributed in eight sub-sections. First of all, the emergence of the sale of the archaic figures with their respective characteristics. Then we develop special sales. The fourth sub-heading develops the constituent elements of the sale: consent, thing and price. Subsequently, the obligations of the seller and those of the buyer. The penultimate section is based on the pacts added to the sale and a sub section dealing with archaic figures. Finally, the third section deals with the sale in the Roman periods post-classic and Justinian.

The second chapter deals with the sale of Spanish Civil law in the different historical stages to the present with the Civil code as a current standard.

The third and final chapter outlines the contracts ' unification projects in the European Union.
