LA PENA DE MUERTE EN ESPAÑA DESDE FINALES DEL ANTIGUO RÉGIMEN HASTA LA DEMOCRACIA

Abstract

[ES] En el presente trabajo se expone la evolución del ius puniendi estatal en su manifestación más absoluta: la pena de muerte. En las últimas décadas del Antiguo Régimen el Estado ejecutaba de forma distinta según el estamento social. Después, con el liberalismo, se impone el principio de igualdad, puesto que se mata a todos por igual. En los periodos dictatoriales encontramos un endurecimiento de la política criminal del Estado, también respecto a la pena capital. Por último, el gran avance llegará con la Constitución de 1978 y el desarrollo legislativo posterior, estableciendo el derecho a la vida como fundamental y eje vertebrador y prohibiéndose, así, la pena de muerte

[EN] In the present dissertation the evolution of the state ius puniendi in its more absolute manifestation is exposed: the death penalty. In the Ancien Régime last decades, the State implemented in different ways according to the social class. The equality principle is imposed with the liberalism, as everyone is equally killed. In dictatorial periods we find a tightening of the State criminal policy, and also with respect to the capital punishment. Finally, the great advance comes with the Constitution in 1978 and the resulting legislative development, establishing the right to life as fundamental and cornerstone, prohibiting the death penalty.
