LAS MEDIDAS CAUTELARES EN EL PROCEDIMIENTO DISCIPLINARIO DE LOS FUNCIONARIOS PUBLICOS.

Resumen
[ES]La existencia de un derecho disciplinario no es especial solo de la Administración Pública sino que es propio de toda agrupación. La idea primordial que persigue este trabajo se basa en el conocimiento de las decisiones que se toman en el seno de un procedimiento administrativo por parte de la administración, es decir, en el conocimiento de las medidas provisionales.
Así mismo el artículo se centra principalmente en la suspensión provisional del empleado público. Esta suspensión comprende dos especies distintas: la provisional y la definitiva lo cual asocia unas consecuencias comunes para ambos tipos de suspensión: el funcionario queda privado temporalmente del ejercicio de sus funciones y de los derechos y prerrogativas que vienen vinculados a su condición de empleado público. La diferencia entre ambos es que la firme es una sanción y la provisional una medida cautelar.
[EN]The existence of a disciplinary law is not special only public administration but is typical of any group. The primary idea behind this work is based on knowledge of the decisions taken within an administrative procedure by the administration, that is, knowledge of the provisional measures. Likewise, the article focuses mainly on the temporary suspension of public employees. This suspension comprises two distinct species: the provisional and final which associates common consequences for both types of suspension: the official is deprived temporarily of the exercise of their duties and rights and privileges that are linked to their status as public employees. The difference between them is that the firm is a provisional sanction and an injunction.
