Cuestiones relativas a la transmisión del ius delationis

Abstract

Una de las cuestiones más complejas del Derecho de Sucesiones es la transmisión del “ius delationis”. Esto se produce cuando un primer causante nombra a un heredero y este fallece sin haber repudiado ni aceptado la herencia, pasando a sus herederos. Esta cuestión se procura resolver a través de las tesis clásica o tesis moderna. En este Trabajo de Fin de Grado se expone un esquema sucesorio del artículo 1006 CC, viendo la capacidad que se requiere para suceder y las distintas etapas que existen cuando una persona fallece y un heredero pasa a ocupar su lugar. Por último, se realizará un análisis de diferentes Sentencias o Resoluciones que han surgido tras la problemática del “ius delationis”.

One of the most complex issues in Inheritance Law is the transmission of the "ius delationis." This occurs when a first testator names an heir and the heir dies without having repudiated or accepted the inheritance, passing it to his or her heirs. This issue is addressed through classical or modern theses. This Final Degree Project presents a succession scheme in Article 1006 of the Civil Code, examining the capacity required to succeed and the different stages that occur when a person dies and an heir takes his or her place. Finally, an analysis will be made of various judgments or resolutions that have arisen from the issue of the "ius delationis."
