RESOLUCIÓN DE CONTROVERSIAS EN MATERIA DE TELECOMUNICACIONES.

Abstract

[ES] Si observamos el mundo que nos rodea, nos daremos cuenta de que asistimos a una era marcada por la evolución de las tecnologías, algo que se hace también patente en las telecomunicaciones, si bien, para el correcto funcionamiento del sector, es necesario que el Derecho se adapte a las circunstancias actuales que surgen fruto de las innovaciones digitales. Partiendo de esto, pretendo mostrar qué es el ámbito de las telecomunicaciones, qué sujetos intervienen en éste y en particular que derechos asisten a los usuarios finales para poder reclamar, desglosando de principio a fin el proceso a seguir para dar solución a las controversias con las compañías telefónicas. Para lograr esto, he realizado un seguimiento de las leyes estatales sectoriales, e igualmente he utilizado la legislación europea, la cual, veremos ha resultado ser determinante a la hora de favorecer la desregularización de las telecomunicaciones.

[EN] If we see the world that involve us, we will know that we are living in a period where the development of the technology is continuous, so to achieve the correct functioning, it is necessary that Law can adapt to the current circumstance result of digital innovation. Due to the fact that, I pretend show what is the field of the telecommunications , who are the subjects that take part in this, and specially what are the rights of the final users to demand, breaking down to the beginning until to the end, of what is the process to give solution to the controversy with the telephone company. To get this, I have made a follow-up about the state law, and equally, I have used European law, which has been decisive to the time of favour the deregulation of the telecommunications.
