Resumen
[ES] Se trata del quebrantamiento de custodia o visita por parte del progenitor o persona cercana que ostente una responsabilidad sobre el menor. Las normas procesales españolas chocan con las extranjeras, produciendo una indefensión del menor para su correcta restitución. Sin embargo, la sustracción internacional de menores tiene a su disposición una serie de mecanismos a su favor para enfrentarse a estas situaciones de vulnerabilidad jurídica. Para ello las Autoridades Centrales deberán cooperar de forma unánime para la búsqueda de una solución eficaz y veloz para que el menor pueda volver a su residencia habitual salvaguardando su integridad.
[EN] It’s about custody or visit breaking by the part of the progenitor or closest person who shows off a responsability over the minor. Spanish adjetive rules collide with foreign ones, producing a defenseless of the minor for their adequate restitution. However, the international kidnapping of minors has at its service a set of mechanisms on its side to face these legal vulnerability situations. For this, Central Authorities must cooperate unanimously for the searching of an effective and fast solution so that the minor can come back to their regular residence safeguarding their integrity.
