EL JUEGO DE LA CLÁUSULA DE DESCONEXIÓN EN LOS NUEVOS INSTRUMENTOS COMUNITARIOS EN EL ÁMBITO DEL DERECHO DE FAMILIA

Abstract

[ES]El presente Trabajo de Fin de Grado se refiere al tema del juego de las cláusulas de desconexión en los nuevos instrumentos comunitarios en el ámbito del Derecho de la Familia a las que se hará alusión durante el presente trabajo de una manera pormenorizada. Para un mejor entendimiento de la problemática en estos aspectos, ya que es de una difícil comprensión, se hará mención a la Conferencia de la Haya, estructura intergubernamental con la que se pretende unir de manera progresiva la normativa jurídica nacional de los diferentes miembros desde la perspectiva del Derecho Internacional Privado. Por otra parte, se hará alusión a las cláusulas de desconexión y a la problemática de las mismas y a los instrumentos comunitarios. En las últimas páginas, se encuentra una conclusión, a modo de resumen y explicación de toda la problemática abarcada.

[EN]This Final Degree Project refers to the theme of the set of disconnection clauses in the new community instruments in the field of Family Law, which will be referred to in this paper in a detailed manner. For a better understanding of the problem in these aspects, since it is difficult to understand, mention will be made of the Hague Conference, an intergovernmental structure that aims to unite in a progressive manner the national legal regulations of the different members from the perspective of Private International Law. On the other hand, reference will be made to the disconnection clauses and to the problems of the same and to the community instruments. In the last pages, there is a conclusion, as a summary and explanation of all the problems covered.
