REFLEXIONES EN TORNO A LAS ÚLTIMAS REFORMAS DE LA LEY ORGÁNICA DEL TRIBUNAL CONSTITUCIONAL

Abstract

[ES] En este trabajo se analizan los motivos y aspectos más relevantes de la nueva reforma de la Ley Orgánica del Tribunal Constitucional. Se describe la necesidad actual y el debate parlamentario llevado a cabo, focalizando el desarrollo de tal reforma en el marco constitucional actual. Se pretende responder a ciertos interrogantes y realizar un análisis crítico sobre la cuestión, analizando por qué el Gobierno ha llevado a cabo la reforma de la LOTC, planteándose que dicha reforma garantice el respeto al Estado de Derecho. Se trata de hacer cumplir la obligatoriedad de las sentencias del Tribunal Constitucional y por este motivo nace tal necesidad en la actualidad. Para ello hemos utilizado una metodología basada en el análisis bibliográfico, artículos de opinión en prensa o blog y normativa legislativa sobre la última reforma de la Ley Orgánica del Tribunal Constitucional.

[EN] This work will analyze the most relevant reasons and aspects of the new reform to the Constitutional Court Organization Act. It will trace the current necessity and the parliamentary debate that has been carried out, focusing on the development of such reform within the current constitutional framework. The aim will be to respond to certain questions and critically analyze the issue, looking at why the Government has carried out Constitutional Court Organization Act reform and examining how said reform guarantees respect for the rule of law. This reform is concerned with enforcing the obligatory nature of Constitutional Court rulings and for this reason it is necessary nowadays. For our purposes we have used a methodology based on bibliographical analysis, newspaper opinion articles, blog articles, and legislative legislation related to the latest Constitutional Court Organization Act reform.
