Resumen
En este trabajo trato la introducci ón de los "fraudes deportivos" en el Código penal español (articulo 285bis.4), la evolución legislativa de este delito hasta nuestros días en comparación con otros ordenamientosjurídico s de nuestro entorno como el italiano. Se entra también en profundid ad a tratar los elementos básicos que lo delimitan, como son el bien jurídico protegido, los sujetos, la conducta típica.
Mención aparte merece la nueva modificación del Código penal operada por la Ley Orgánica 112015 de 22 de marzo, que afecta a los fraudes deportivos en el ámbito de aplicación de los mismos y en la introducción de un nuevo tipo agravado.
In this work I try the introduction of " sports fraud " in the Spanish pen al code (article 285bis.4), the legislative evolution of this crime until today compared to other legal systems of our environment as the Italian. It also goes into depth to address the basic elements that define, such as the lega lly protected, subjects and typical behavior. The new amendment to the penal code operated by the Organic Law 1/2015 of 22 March, affecting sports fraud in the scope thereof and the introduction of a new type worsened.
